THIS AGREEMENT GOVERNS YOUR USE OF THE MMC HEALTH & WELLNESS CENTER WEBSITE AND ONLINE SERVICES. PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING OUR PLATFORM.

ACCEPTANCE OF TERMS

By accessing, browsing, or using the MMC Health & Wellness Center website, mobile interfaces, or online booking features (collectively, the “Site”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you are expressly prohibited from using the Site and must discontinue use immediately. These Terms apply to all visitors, users, patients, and others who access or use our online services in Norwalk, Connecticut, and across the state.

NO EMERGENCY MEDICAL SERVICES

THE SITE AND ITS CONTENT ARE NOT INTENDED TO PROVIDE EMERGENCY MEDICAL CARE OR IMMEDIATE CRISIS INTERVENTION. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY OR GO TO THE NEAREST HOSPITAL EMERGENCY ROOM. DO NOT ATTEMPT TO USE THIS SITE, CONTACT FORMS, OR TELEHEALTH BOOKING TOOLS TO OBTAIN URGENT MEDICAL ASSISTANCE.

 

NATURE OF WEBSITE CONTENT AND MEDICAL DISCLAIMER

The information, graphics, text, service descriptions, and other material provided on this Site are for general informational and educational purposes only. While MMC Health & Wellness Center offers clinician-led primary care, medical weight management, and specialized evaluation services, accessing information on this Site does not create a clinician-patient relationship between you and MMC Health & Wellness Center or any of its providers. A clinician-patient relationship is established only after a formal clinical intake, consultation, and signed consent for treatment. Content on the Site should never replace professional medical diagnosis, advice, or treatment from a qualified healthcare practitioner.

SERVICES AND HYBRID CARE MODEL

MMC Health & Wellness Center provides adult primary care, general medicine, GLP-1 weight management, metabolic programs, lifestyle planning, and independent medical evaluations, including Compensation & Pension (C&P) exams for military veterans. We deliver care through a hybrid model involving in-person visits in Norwalk, Connecticut, and virtual telehealth appointments throughout Connecticut. Services booked through the Site are subject to clinician availability, geographic residency verification, and professional clinical discretion. We reserve the right to decline, modify, or cancel appointments if telehealth or in-person care is determined inappropriate for your clinical needs.

ONLINE BOOKING AND PATIENT COMMUNICATIONS

When you schedule an appointment or submit an inquiry through our online booking portals, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of any patient portal credentials or account access details. You agree that sending electronic communications through unencrypted channels such as standard website contact forms or public email is not completely secure. While MMC Health & Wellness Center maintains technical safeguards, sensitive medical records and detailed health histories should be transmitted through our designated, secure patient portal or discussed directly during clinical visits.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site and all of its content, including but not limited to source code, databases, website designs, audio, video, text, photographs, graphics, logos, brand names, and service descriptions (collectively, the “Content”), are owned or controlled by MMC Health & Wellness Center or licensed to us. The Content is protected by copyright, trademark, and other intellectual property laws of the United States. You are granted a limited, non-exclusive, non-transferable license to access and view the Site for personal, non-commercial use only. No part of the Site or Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, or distributed for any commercial purpose without our express prior written permission.

PROHIBITED USER ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make it available. As a user of the Site, you agree not to:

– Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, database, or directory without written permission.

– Trick, defraud, or mislead us or other users, especially in any attempt to learn sensitive patient account information or personal health data.

– Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content.

– Use any information obtained from the Site to harass, abuse, or harm another person or clinician.

– Use the Site in a manner inconsistent with any applicable state, federal, or local laws and health regulations.

– Upload or transmit viruses, Trojan horses, or other malicious code that interferes with the proper operation of the Site or our telehealth platforms.

THIRD-PARTY LINKS AND SERVICES

The Site may contain links to third-party websites, external health portals, scheduling platforms, or payment processors that are not owned or controlled by MMC Health & Wellness Center. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities or individuals. You acknowledge and agree that MMC Health & Wellness Center shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of any third-party content, goods, or services.

TELEHEALTH SERVICES AND STATE JURISDICTION

Telehealth services offered through our platform are provided by licensed providers in accordance with Connecticut medical licensing laws and regulations. To receive virtual care, you must be physically located within the state of Connecticut at the time of your telehealth visit. You agree to accurately declare your physical location prior to commencing any telehealth consultation. MMC Health & Wellness Center makes no representation that services offered through the Site are appropriate or available for use in locations outside Connecticut.

FEES AND PAYMENT TERMS

Fees for clinical consultations, medical weight management programs, routine screenings, and evaluation services are due at the time of service or as outlined in your patient agreement. If you make payments or book fee-based services through the Site, you agree to provide valid, current payment details. You are responsible for all charges incurred under your name, including any applicable cancellation or late-rescheduling fees detailed in our clinical policies.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MMC HEALTH & WELLNESS CENTER, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR CLINICIANS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless MMC Health & Wellness Center, including our clinicians, staff, officers, and contractors, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, your breach of these Terms, or your violation of the rights of a third party.

GOVERNING LAW AND JURISDICTION

These Terms and your use of the Site are governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in Connecticut, and you hereby consent to personal jurisdiction and venue in such courts.

CHANGES TO TERMS OF SERVICE

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the “Effective Date” of these Terms. It is your responsibility to periodically review these Terms to stay informed of updates. Your continued use of the Site after the posting of revised Terms signifies your acceptance of the changes.
